TATUNG TABLET PC PRODUCTS LIMITED WARRANTY

TATUNG currently provides a 1-year limited warranty as a standard offering for Tatung Tablet PC products, which covers the Tablet PC, Hard drive and memory and a 90-day Limited Warranty for Li-Ion Battery, AC Power Pack, External Charger, and Digitizer Pen.)
This Limited Warranty applies to the TATUNG Tablet PC hardware products sold by Tatung Science and Technology, Inc. (TSTI) and its authorized resellers in US. These terms and conditions constitute the complete and exclusive warranty agreement between you and TATUNG regarding the TATUNG Tablet PC products you have purchased. These terms and conditions supersede any prior agreements or representations made in TATUNG sales literature or advice given to you by TATUNG or an agent or employee of TATUNG that may have been made in connection with your purchase of the TATUNG Tablet PC product. No change to the conditions of this Limited Warranty is valid unless it is made in writing and signed by an authorized representative of TATUNG.
WARRANTY PERIOD
The warranty period for this TATUNG Tablet PC Product is one (1) year from the date of product purchase. The Limited Warranty Period starts on the date of purchase from TSTI. Your dated sales or delivery receipt, showing the date of purchase, is your proof of the purchase date. You may be required to provide proof of purchase as a condition of receiving warranty service. This limited warranty is valid only within the United States of America.
WARRANTY COVERAGE
TATUNG warrants that the TATUNG Tablet PC Product and all the internal components of the product that you have purchased from TSTI are free from defects in materials or workmanship under normal use during the Limited Warranty Period. TATUNG shall have no responsibility for any deficiency resulting from accidents, misuse, or modificationsunless authorized by TATUNG in writing. You are entitled to warranty service according to the terms and conditions of this document if a repair to your TATUNG Tablet PC Product is required within the Limited Warranty Period. This Limited Warranty extends only to the original purchaser of this TATUNG Tablet PC Product and is not transferable to anyone who obtains ownership or use of the TATUNG Tablet PC Product from the original purchaser.
LIMITATION OF LIABILITY
In no event shall TATUNG be liable for damages, in the aggregate, exceeding the original purchase price of the hardware and the media if any. The disclaimer of consequential damages and limitation of liability are a material aspect of the allocation of risks under this agreement, and TATUNG has received no consideration for assuming any risk in excess of that explicitly set forth in this agreement.
WARRANTY DISCLAIMER
EXCEPT AS EXPRESSLY SET FORTH IN THIS LIMITED WARRANTY, TATUNG MAKES NO OTHER REPRESENTATIONS, WARRANTIES OR CONDITIONS, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED REPRESENTATIONS, WARRANTIES OR CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND NON-INTERFERENCE. TATUNG DOES NOT WARRANT THAT YOUR USE OF THE TATUNG PRODUCT WILL BE UNINTERRUPTED OR ERROR-FREE. ANY IMPLIED WARRANTIES THAT MAY BE IMPOSED BY LAW ARE LIMITED IN DURATION TO THE LIMITED WARRANTY PERIOD. SOME STATES OR COUNTRIES DO NOT ALLOW A LIMITATION ON HOW LONG AN IMPLIED WARRANTY LASTS OR THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES FOR CONSUMER PRODUCTS. IN SUCH STATES OR COUNTRIES, SOME EXCLUSIONS OR LIMITATIONS OF THIS LIMITED WARRANTY MAY NOT APPLY TO YOU.
SOFTWARE AND DATA
YOU SHOULD MAKE PERIODIC BACKUP COPIES OF THE DATA STORED ON YOUR HARD DRIVE OR OTHER STORAGE DEVICES AS A PRECAUTION AGAINST POSSIBLE FAILURES, ALTERATION, OR LOSS OF THE DATA. BEFORE RETURNING ANY UNIT FOR SERVICE, BE SURE TO BACK UP DATA AND REMOVE ANY CONFIDENTIAL, PROPRIETARY, OR PERSONAL INFORMATION. TATUNG IS NOT RESPONSIBLE FOR DAMAGE TO, LOSS OF, OR DISCLOSURE OF ANY PROGRAMS, DATA, OR REMOVABLE STORAGE MEDIA. TATUNG IS NOT RESPONSIBLE FOR THE RESTORATION OR REINSTALLATION OF ANY PROGRAMS OR DATA OTHER THAN SOFTWARE INSTALLED BY TATUNG WHEN THE PRODUCT IS MANUFACTURED.
TATUNG DOES NOT WARRANT SOFTWARE PRODUCTS, INCLUDING ANY SOFTWARE PRODUCTS OR THE OPERATING SYSTEM PREINSTALLED BY TATUNG. TATUNG's only obligations with respect to software distributed by TATUNG under the TATUNG brand name are set forth in the applicable end-user license or program license agreement. Non-TATUNG software products are provided "AS IS." Non-TATUNG manufacturers, suppliers, or publishers may provide their own warranty and software license agreement directly to you.

REPAIR OR REPLACEMENT
During the Limited Warranty Period, TATUNG Tablet PC products and spare parts are warranted to be free from defects in material or workmanship for thirty (30) days after repair and replacement or for the remainder of the Limited Warranty Period of the TATUNG Tablet PC Product in which they are installed, whichever is longer. In the unlikely event that your TATUNG Tablet PC Product has a recurring failure, TATUNG, at its discretion, may elect to provide you with a replacement unit of TATUNG's choosing that is at least equivalent to your TATUNG Tablet PC Product in hardware performance. TATUNG reserves the right to elect, at its sole discretion, to give you a refund up to your purchase price instead of a replacement. THIS IS YOUR EXCLUSIVE REMEDY FOR DEFECTIVE PRODUCTS.
ENTIRE AGREEMENT
This Limited Warranty and the Software License Agreement are the entire agreement relating to the use of the Media and the Hardware and supersede all prior oral and written agreements relating thereto. All amendments to these agreements must be approved in writing by TATUNG. No waiver of violations of the terms of these Agreements shall be effective unless it is given in writing and shall not be deemed a waiver of future violations.
